There are several reasons why intellectual property requires different legal protections than tangible or real property. Intellectual property is considered things that are created from the mind to include: “patents, copyrights, trade names, and trade secrets” (Lee, 2020). Where “tangible property is any property, real or personal, that can be touched. Real property consists of land or real estate that cannot be moved or is attached to the property, such as buildings, oil, gas and minerals, and trees. Personal property is property that can be moved, such as machinery, equipment and furniture” (Grant Houston).

There needs to be different legal protections for intellectual property such as patents, copyrights, trade names, and trade secrets because these are things that have been created from original innovation, and the creator of these innovation need to be protected from other people having the ability to take claim for their innovation, and therefore the creator should be the only one who decides how these innovation should be use or can be used by other people. One of the biggest reasons why different legal protection is used when it comes to tangible or real property because this type of property is “not indefinite and may be lost through sale, gift, or inheritance” (Lee, 2020).

“Intellectual property law differs from other property law in that intellectual property law protects rights in intangible property, whereas other property law protects tangible, or physical, property. Thus, intellectual property law deals with abstract concepts, rather than with concrete physical objects. The physical manifestations of the work product of the protected intellectual property may be protected by other property law, but it will not be protected by intellectual property law.”
